Copyright & DMCA Policy
every beat u need respects intellectual property rights and expects its users to do the same. This policy explains ownership, prohibited uploads, and how to report or respond to claimed infringement.
1. Ownership & License Grant
Producers retain the copyright to the beats they upload. By purchasing, a buyer receives a license under the specific tier they select — not a transfer of copyright, except where an Exclusive license and any separate written assignment provide otherwise. All rights not expressly granted by the applicable license agreement are reserved by the producer.
By uploading, a producer grants every beat u need a limited, non-exclusive license to host, stream previews of, display, and deliver the beat to buyers solely to operate the marketplace.
2. Prohibited Uploads
You may not upload:
- Beats you do not own or are not fully authorized to license.
- Material containing uncleared third-party samples, interpolations, or copyrighted recordings.
- Content that infringes any copyright, trademark, or other right of a third party.
- Beats already sold or assigned exclusively to another party.
Producers warrant sole creation and ownership of each uploaded beat and authority to license it.
3. DMCA Takedown Notice
If you believe content on every beat u need infringes a copyright you own or control, send a written notice to our Designated Agent at everybeatuneed@gmail.com. To be effective under 17 U.S.C. § 512(c)(3), your notice must include all six of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing and information reasonably sufficient to let us locate it (for example, the beat URL).
- Your contact information — name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
Upon receiving a valid notice we will remove or disable access to the material and take reasonable steps to notify the producer.
4. Counter-Notification
If your content was removed and you believe this was a mistake or misidentification, you may send a counter-notification under 17 U.S.C. § 512(g) to everybeatuneed@gmail.com. It must include your signature; identification of the removed material and its former location; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; and your name, address, and telephone number, together with your consent to the jurisdiction of the federal court for your district (or, if outside the U.S., any district in which we may be found) and your acceptance of service of process from the complainant.
If we receive a valid counter-notification, we may restore the material in 10–14 business days unless the original complainant notifies us that they have filed a court action.
5. Repeat-Infringer Policy
In appropriate circumstances, and at our discretion, we terminate the accounts of users who are found to be repeat infringers.
6. Sample-Clearance Responsibility
Clearing any sample, interpolation, or other third-party material is the producer’s sole responsibility. The producer indemnifies and holds harmless every beat u need from any claim, loss, or liability arising out of uncleared material or a breach of these representations.
7. Trademark
“every beat u need” and associated logos are marks of the Platform. Third-party names, artist names, and marks referenced in beat titles or “type beat” tags remain the property of their respective owners and are used only for descriptive, nominative purposes.
8. Disclaimer
every beat u need acts as a marketplace facilitator and is not a party to any license agreement between a producer and a buyer. The Platform makes no warranty regarding the ownership, originality, or clearance of any beat and disclaims all liability to the maximum extent permitted by law. This policy does not constitute legal advice.
